Terms of Service

1. Acceptance of Terms

By accessing or using AI Anyone ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Account Registration

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

• You must provide accurate and complete information during registration, including your year of birth
• You must be at least 13 years old to create an account. We do not knowingly create accounts for children under 13
• Chat is 18+. If you are under 18 you can browse characters, build your own characters, and take courses, but you cannot send messages to an AI character
• Those are two separate limits and both apply. Being old enough to hold an account does not by itself mean you are old enough to chat
• We apply both limits from the year of birth you give us. We do not check it against a document, so it depends on an honest answer
• If you are under 18, a parent or guardian can email support@aianyone.com to see, correct, or delete your account and the information we hold about you. Our Privacy Policy explains how that works
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• AI Anyone reserves the right to verify your age and may restrict or terminate accounts that provide false age information

3. Payment Terms

3.1 Platform Subscriptions

AI Anyone offers two subscription tiers:

• Free: unlimited messages with 13,000+ AI minds, on the full model for the first 100 a day and a lighter model after that, plus unlimited activities and learning games, unlimited custom characters, and 20 minutes of voice calls per rolling 30 days
• Pro: everything in Free, plus the Pro features listed below. Pro is billed monthly, or yearly where offered, at the price shown at checkout.
• Pro-only features become unavailable when Pro ends

Pro includes:

• 240 minutes of voice calls per rolling 30 days, where Free has 20
• Choosing the voice a character uses on your calls
• Chat that stays on the full model, where Free moves to a lighter model after the first 100 messages each day
• 100 read aloud listens per rolling 30 days, where Free has 5 in total
• A higher monthly limit on AI-built courses than Free
• Exporting a conversation as Markdown or PDF

3.2 Recurring Billing

• By subscribing to Pro, you authorize AI Anyone to charge your payment method when you subscribe and again at the start of each billing period, monthly or yearly depending on the plan you chose
• Pro renews automatically at the price shown until you cancel.
• You are responsible for keeping your payment method on file current and valid; if your payment method expires or is declined, you must update it promptly
• If a renewal payment fails, Pro pauses until the payment goes through. Update your card in Manage subscription. The payment may be retried, and we email you when a renewal payment fails.

3.3 Cancellation

• Cancel anytime in Settings, then Billing, then Manage subscription. You keep Pro until the end of the period you already paid for, and you are not charged again.
• No partial refunds are issued for the unused portion of a billing period
• After cancellation takes effect, your account returns to the free tier and Pro-only features become unavailable
• Deleting your account cancels your Pro subscription right away, and you are not charged again.

3.4 Price Changes

We may change the price of Pro. If we raise the price of your plan, we will email you between 7 and 30 days before the new price takes effect, and that email will tell you how to cancel. If you do not want to pay the new price, cancel before it takes effect and you will not be charged it.

3.5 Free Trials and Promotional Access

We may offer free trial periods for certain subscription plans that require a payment method. At the end of such a trial, your subscription will automatically convert to a paid subscription and your payment method on file will be charged at the applicable rate unless you cancel before the trial period ends. We will notify you before a trial of that kind converts to a paid subscription.

Separately, we may grant Pro features for a fixed period at no charge ("promotional access"), for example a month of Pro free when you create an account, or additional months earned by referring friends. No payment method is collected for promotional access, nothing is charged when it ends, and your account returns to the free plan. Promotional access is personal to your account, is not transferable or redeemable for cash, may be capped, and may be withheld or revoked where we detect abuse, including referring yourself or creating accounts to earn rewards.

3.6 Refunds

Subscription payments are non-refundable except where required by law. Cancelling stops the next charge and does not refund the period you already paid for. If you think a charge is wrong, email support@aianyone.com.

4. Intellectual Property

You retain ownership of the characters and content you create on the Platform. By publishing characters, activities, or other content publicly, you grant AI Anyone a non-exclusive, worldwide license to display, distribute, and promote that content on the Platform.

For an AI clone, that license ends when you delete the clone or your account, except for copies other users already hold in their own conversation history and the records described in our Privacy Policy.

AI Anyone's platform, branding, and technology are the property of AI Anyone and are protected by applicable intellectual property laws.

Copyright Complaints

If you believe content on the Platform infringes your copyright, send a notice to support@aianyone.com that includes: a description of the copyrighted work, the location of the allegedly infringing content, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement that the information in your notice is accurate. We will review valid notices and remove or restrict infringing content where appropriate, and we terminate accounts of repeat infringers. An account that accumulates 3 valid takedown notices within 12 months is terminated; strikes expire 12 months after the date of the notice, and a notice that is withdrawn, found invalid, or successfully counter-noticed does not count. 5. Prohibited Content & Conduct

You may not use the Platform to:

• Publish content that infringes on others' intellectual property rights
• Upload harmful, abusive, or illegal content
• Misrepresent AI-generated content as real communications from actual people
• Use realistic photographs of real individuals as AI personality avatars
• Engage in fraud, phishing, or deceptive practices
• Attempt to circumvent platform security or payment systems
• Harass, bully, or threaten other users

Violation of these terms may result in account suspension or termination without refund.

6. Dispute Resolution

6.1 Payment Disputes

If you have a dispute regarding a payment or charge, please contact us at support@aianyone.com before initiating a chargeback with your bank. We are committed to resolving issues fairly and promptly.

6.2 Content Disputes

If you believe content on the Platform infringes your intellectual property or violates our guidelines, please contact support@aianyone.com with details of the alleged violation. See Section 4 for our copyright complaint process.

6.3 Negotiation First

Before pursuing formal proceedings, you agree to first contact us at support@aianyone.com so we can try to resolve the dispute through good-faith negotiation. Governing law, binding arbitration, and the class action waiver are set out in Section 13.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI ANYONE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Damages arising from AI-generated content, including any actions taken based on information provided by AI personalities
• Emotional, psychological, or mental health impacts resulting from interactions with AI features
• Loss of data, revenue, profits, or business opportunities
• Any harm resulting from unauthorized access to or alteration of your data or transmissions
• Any failure of AI safety systems, content moderation, or crisis detection features
• The conduct of any third party on the Platform, including other users and AI-generated content

AI-generated content, including conversations with AI personalities and AI-generated course materials, is provided for educational purposes only and should not be considered professional advice of any kind. Users rely on such content entirely at their own risk.

IN NO EVENT SHALL AI ANYONE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO AI ANYONE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. AI Content Disclaimer

AI Anyone uses artificial intelligence to power various features on the Platform, including AI personalities, AI-assisted course creation tools, and AI-generated learning content. By using these features, you acknowledge and agree to the following:

8.1 Nature of AI Interactions

• AI Personalities are simulations, not real people: AI personalities available on the Platform are computer-generated simulations. They are not real people, do not represent real people, do not have consciousness, emotions, feelings, or awareness, and cannot form genuine relationships with users. Every response is artificially generated, not authored by a human
• Responses are generated and may be inaccurate: All AI responses are produced by automated systems and may be inaccurate, incomplete, or misleading. Do not rely on them as fact
• May not be suitable for some minors: Because AI-generated content is unpredictable, the Platform may not be suitable for some minors. Parents and guardians should review whether the Platform is appropriate for a given child
• No human connection: Interactions with AI personalities are not a substitute for real human relationships, professional counseling, therapy, or any form of human support. Users should not rely on AI personas for emotional support, companionship, or as a replacement for human interaction
• Educational purpose: AI personalities on this Platform are designed for educational and learning purposes. They are tools to facilitate understanding of subjects, not companions, friends, therapists, or advisors
• Accuracy not guaranteed: AI-generated content may contain inaccuracies, errors, hallucinations, or outdated information. Users should independently verify any critical information obtained through AI interactions
• No endorsement: The views, opinions, or statements expressed by AI personalities do not reflect the views of AI Anyone, its employees, affiliates, or any real individuals the personas may be modeled after

8.2 AI Interactions Are Not Professional Advice

• AI-generated responses do not constitute and should never be relied upon as medical, psychological, psychiatric, legal, financial, or any other form of professional advice
• If you or someone else is in crisis, experiencing suicidal thoughts, or thinking about self-harm, contact the 988 Suicide and Crisis Lifeline (call or text 988), the Crisis Text Line (text HOME to 741741), or your local emergency services. Outside the United States, find a helpline at findahelpline.com. See our Safety and Crisis Resources page for more
• AI Anyone is not a crisis service, healthcare provider, mental health service, or counseling service. Surfacing or providing crisis resources does not make us a healthcare provider, and no AI interaction is a substitute for professional care or emergency services
• No AI interaction on this Platform creates a doctor-patient, therapist-client, attorney-client, or any other professional relationship

8.3 Safety Measures & Content Moderation

• AI Anyone implements automated safety systems including crisis keyword detection that may surface mental health resources during conversations
• While we employ content moderation and safety guardrails, no automated system is perfect. AI-generated outputs may occasionally produce unexpected, inappropriate, or harmful content
• Users should report any concerning, harmful, or inappropriate AI-generated content to support@aianyone.com
• If you believe a character uses your name, image, voice, or likeness without permission, or you have any other likeness or safety concern, report it to support@aianyone.com and we will review and remove or restrict the content where appropriate
• AI Anyone reserves the right to monitor, review, and moderate AI conversations for safety purposes
• Conversation data may be used to improve safety systems and content moderation

8.4 Users Under 18

• Chat is 18+. An account whose year of birth puts its holder under 18 cannot send messages to an AI character. The same limit applies to a visitor who is not signed in and tells us they are under 18
• This replaces our previous approach. We used to let minors chat with extra guardrails on the AI. We no longer do, because chat is the part of the Platform where AI-generated content is least predictable
• Everything else stays open. Under 18 you can browse every character, build your own characters, and take courses
• We apply this from the year of birth you give us, which we do not check against a document. Giving a false one may cost you the account
• Parents and guardians: email support@aianyone.com to see, correct, or delete a minor's account and the information we hold about it
• No safety measure is complete. AI-generated content is unpredictable, and we encourage parents and guardians to stay aware of how a minor uses the Platform

8.5 User Responsibilities Regarding AI

• You understand that AI personalities are not sentient beings and that forming emotional dependencies on AI interactions is not the intended use of this Platform
• You agree not to use AI features to generate harmful, illegal, sexually explicit, or dangerous content
• You agree not to attempt to manipulate AI personalities into producing content that violates our safety guidelines or content policies
• You are solely responsible for how you interpret and act upon information provided by AI personalities
• You agree not to misrepresent AI-generated content as communications from real people

9. Data Handling & Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect and process personal data necessary to provide the Platform's services, including account information, payment details, and usage data
• Payment information is processed securely through a third-party payment processor and full card numbers are not stored on our servers
• Conversations with AI personalities may be stored to improve service quality and are subject to our data retention policies
• You can delete your account yourself in Settings, or request deletion of your personal data by contacting us at support@aianyone.com
• We do not sell your personal information to third parties

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination:

• Your access to Pro features may be revoked
• You remain responsible for any outstanding charges
• We may unpublish or remove any AI clone on the account
• Your personal information, including any AI clone, is handled as our Privacy Policy describes

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Anyone, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or inability to use the Platform, including AI interaction features
• Your violation of these Terms or any applicable law or regulation
• Your violation of any rights of any third party
• Any content you submit, post, or transmit through the Platform
• Any misuse of AI-generated content, including reliance on AI responses as professional advice
• Your failure to provide accurate registration information, including age
• A minor's use of the Platform under your account or with your consent

12. Assumption of Risk

By using the Platform, you acknowledge and agree that:

• AI technology is inherently unpredictable and may produce unexpected, inaccurate, or inappropriate outputs despite safety measures
• You voluntarily assume all risks associated with using AI-powered features, including but not limited to risks related to content accuracy, emotional impact, and reliance on AI-generated information
• AI Anyone's implementation of safety features (including crisis detection, content moderation, and age-based restrictions) does not guarantee the prevention of all potentially harmful content or interactions
• You have been informed that AI personalities are not real entities and cannot provide genuine emotional support, medical advice, or crisis intervention
• You are responsible for your own well-being and should seek appropriate professional help for any medical, psychological, legal, or financial matters

13. Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and AI Anyone agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform (including AI interaction features) shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property infringement.

• No Class Actions: You agree that disputes will be resolved only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration
• Arbitration Rules: Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits
• Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@aianyone.com within 30 days of creating your account. Your notice must include your name, email, and a clear statement that you wish to opt out of arbitration
• Severability: If the class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void

Governing Law: These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Wayne County, Michigan.

14. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and any policies referenced here, are the entire agreement between you and AI Anyone regarding the Platform and supersede any prior agreements
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect
• Waiver: Our failure to enforce any provision is not a waiver of our right to do so later
• Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets
• No Third-Party Beneficiaries: These Terms do not create any rights for anyone other than you and AI Anyone
• Notices: We may provide notices to you by email or by posting them on the Platform. You may contact us at support@aianyone.com
• Survival: Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive

15. YouTube API Services

Parts of the service use YouTube API Services to find and embed videos that are relevant to a lesson. By using those parts of the service, you agree to be bound by the YouTube Terms of Service, in addition to these Terms. Google's handling of data collected when a video is embedded or played is governed by the Google Privacy Policy.

Videos are shown only in the official YouTube embedded player, with the title and channel attributed and a link out to watch on YouTube. We do not download, re-host, modify, or separate audio from any video, we do not place advertising on pages containing YouTube content, and we do not retrieve YouTube content by any means other than the YouTube Data API.

Videos belong to their creators and to YouTube, not to us. Nothing in these Terms grants you any right in a video beyond what the YouTube Terms of Service allow, and a video may become unavailable at any time if its owner or YouTube removes it.

16. AI Clones

If you build an AI clone of yourself:

• It must be a clone of you. You may build it only from material you created or have the right to use, and you confirm that before it is built
• It is labeled as AI in every chat. Do not present your clone, or anything it says, as a real message from you or from anyone else
• You are responsible for the material you build it from
• We may unpublish or remove a clone that breaks these Terms, including one that impersonates someone else
• You can unpublish your clone at any time, or delete it from your clone dashboard. What deleting it removes, and what is kept, is described in our Privacy Policy
